i have no idea from here... however, it looks like a male.

Moved from Achradocera. The only species east of the Rockies, and distinguishable from the other North American species by the shape of the hind femur. (Van Duzee, 1924)

Identification
This is a male specimen of an Achradocera species (subfamily Diaphorinae - Dolichopodidae). Only males have a postpedicel with this particular shape.
