Is this Araneus sp. the garden spider?

Would certainly say
that it's the same as the next one you posted

 
I believe
these are N. arabesca based on the picture in Kansas orb weaver checklist. Every field I visit in FL has specimens identical to the checklist photo, along with numerous color variants, especially the females. The males tend to look the same from what I have seen, although this may not be the case elsewhere.
The species is also widespread throughout Canada and the US.
