Although size is a bit difficult to judge here, this looks more like a melanic Acronicta fragilis (like the one figured on the Butterflies and Moths of North America website). Note the large, near circular orbicular spot without a central "dot" and the white "W" on the strongly incurved post-median band at the anal edge of forewing. Forewings are also "stubbier" and more "squarish" than in A. noctivaga. Also the white hindwings point to A. fragilis, as they would typically be smokey brown in A. noctivaga.
