unknown fly - Homoneura occidentalis

unknown fly - Homoneura occidentalis
Aromas, San Benito County, California, USA
September 25, 2007
Size: ~3mm
Saw this guy on a live oak leaf, near our compost bins (live oak/chaparral habitat). Could be some kind of fruit fly?

Homoneura occidentalis
Although from this photo you can't tell the difference between the 2 species in the Homoneura occidentalis group (H. occidentalis and H. arizonensis), this photo is very likely to be Homoneura occidentalis. In California, H. arizonensis only occurs in the very southeastern part of the state (and east to Arizona, of course), while this specimen is from the western part of the state, just south of SF Bay.
