Initially thought this was Maculifrons, but after looking at the length of the abdomen and the markings, I'm not sure. Could this be a queen?

and its not maculifrons.... i think it might be the downy yellowjacket, vespula flavopilosa

 
This is the Downy Yellowjacket
Vespula flavopilosa. Some V. vulgaris males can have just the same color pattern, but then head an thorax are distinctly hairier.

I had a feeling it was not Maculifrons. I did give the Downy some thought but couldn't determine if that was right either. If it is the downy, it is the first one I have photographed.
