Acroceridae: Ogcodes rufoabdominalis
A great shot! As far as I know this is the only North American species in Ogcodes that has the yellow-orange abdomen.

 
Ogcodes dispar, sorry!
That's what I get for trying to use my memory. This is Ogcodes dispar, the males are typically bright yellow-orange. The thorax should be dark for O. rufoabdominalis. The species is widely distributed in eastern North America, though uncommonly encountered.

Wow.
I am pretty sure this is a small-headed fly in the family Acroceridae, in which case this could be something rather rarely seen. Looking forward to seeing what our fly experts have to say.
