You're ID is correct, a worn Acronicta ovata.

It does look worn, but the original image is actually at a high enough resolution that I can see the individual scales and none appeaar missing.

Ovata
I can see missing scales on the left forewing AM markings and on the PM lines. It's not terribly worn by any means though. Either way, it's an ovata, and a great image of one at that.
