Near match
This is very close to genus Guttipelopia, except for the pattern on the legs. Compare http://popgen.unimaas.nl/~jlindsey/commanster/Insects/Flies/SpFlies/Guttipelopia.guttipennis.html.

The color and banded legs usually mean Tanypodinae, but a proper ID needs a look at the wing veins and I can't make them out.

Looks to be a midge (Chironomidae) or wood gnat (different family, the name of which has not been committed to my memory:-).
