Fruit fly? - Chymomyza amoena

Size: ~4mm
This fly was collected from a pear tree. It would periodically hold both wings up as it walked around. I'm guessing it's something from family Tephritidae, but I'm not sure.

Actually, no
This is a fruit fly (Drosophilidae) but of the genus Chymomyza, C. amoena. Breeding in rotting fruits (e.g., apples, chestnuts).
