Size: 4mm
Found on trunk of Crepe Myrtle tree next to a lake.

Nope
Wrong family!
This is a long legged fly, family Dolichopodidae, and genus will be Medetera, usually found on tree trunks.
Try googling Medetera and you'll see!

Wonder what's up with the near vertical stance of these flies? Mine looks a lot like the one in the image on the right.
