Fly
Appears to have halteres, making it a fly. The long beak and funny shaped antennae ought to give somebody a clue.

 
I'm not too good with haltere
I'm not too good with halteres on tiny things, but I think you might be right. The front legs do look a little bit "fly-ey" as well.

 
Dance fly.
These are dance flies, family Empididae. The long beak and round head, with very short antennae are clues here.
