Wrong family:-)
This is a "flutter fly" in the family Pallopteridae, easily confused with the Tephritidae. These are supposedly uncommon flies, so nice find, great image!

 
Toxoneura species
There's only one genus of Pallopteridae in North America so I moved the image to the new genus page.
