One way you can tell if somethings a fly is by those little clubs under its wings

 
Black Fly
My initial impression was that it was a fly but then I began to doubt myself because of the coloration and the lack of wing sections (which may have more to do with the quality of the photo anyway). Thought I'd hedge my bets as to what it was.
