I was confused about what groups went in what subfamilies in the new (post-1992) classification.

The two flies have different bristles on the thorax and different wings.

 
Oh yeah... I didn't recognize it
The one I found this winter was ~2.5 mm... 2 to 5 mm does seem like a big range though. Are you including the wings in your measurement? Even then, I'd only get 3 mm or so.

 
Whenever I can see the end of the abdomen, I measure just the body length. This could be a species with a wide range of sizes.
