Definitely Agromyzidae
From what I can see, the colour also matches the description of Liriomyza nigriscutellata, which is only known from California. The host is unknown, so it would be interesting to know what that plant is.

 
Agreed. Agromyzidae
Many are found nearby (San Joaquin Marsh for instance), identical with this except for a more metallic abdomen. Posture is quite typical.
