Size: 4 mm
Two shots of same individual on shrub in woods; thought it might be Tephritidae but couldn't find image with matching wing pattern, so not sure.

Pallopteridae
From the Manual of Nearctic Diptera I gather this is a species of Toxoneura (possibly T. superba) of the family Pallopteridae. There is still some discussion whether Toxoneura should be considered distinct from Palloptera or as synonym, but it probably is best just to follow the Manual for now.
