Ulidiidae: Ceroxys

Eric Fisher identified your other picture of this fly, this is probably the same species.

Most likely a fruit fly (Tephritidae)
Check: Rhagoletis, using search

BTW, Welcome to Bug Guide! Nice clear photo, but tighter cropping often aids ID.
