Caloptilia ostryaeella
According to the images on the BOLD Taxonomy Browser, Caloptilia ostryaeella has two distinct color forms, a "yellow and brown" one and a "dark" one. Your moth appears to be a good match for some of the BOLD images of the dark form of this species.

Could be Gracillariidae
Maybe Caloptilia serotinella? Although the lighter patches on the wing look too yellow.
