Size: 4-5 mm
Is this Ochthera tuberculata?. My backyard has small wetland with a creek running thru it, and this flies were very common along the wateredge. Their display of their front legs to expose a white spot reminded me on Fiddler crabs. They seem to hop away rather than fly.

Probably tuberculata
Probably Ochthera tuberculata, if the fore tarsi really are pale and not black and overexposed.

I caught one of the flies today and confirmed with a hand lens the fore tarsi is black. I exchanged some of the photos for clearer pics.
