The proximity of the markings
The proximity of the markings on tergite 2 would make me think this was Metasyrphus.

This is not extraordinarily dark. Could be Metasyrphus americanus, M. fumipennis ?? This is a female.

 
If it was photographed on Jan
If it was photographed on Jan 4th then that might explain why this is quite dark. Many Syrphids seen early in the year are darker than summer forms.
