I submitted yesterday what I thought to be the same fly but looking closely I noticed that on this one the wing is damaged and different color the body has a different color too .

Nice photo, Stoil. I agree with P. texana here. The lack of strongly defined pollinose markings on the pleura and humeri, together with a number of subtleties of overall coloration & markings (e.g. abdomen mostly red with black dorsal spots; "T" on frons very narrow and tinged reddish; vertex very yellowish; etc) seem to point to texana rather than marginata (which is the next best fit, considering hyaline discal cell and location). If you happen to have a frontal view photo showing the facial grooves (below the antennae and above the mouthparts) that could unequivocally verify the ID (facial grooves pale whitish in texana, versus dark in marginata).
