Unknown fly - Heteromeringia nitida

Found on a streambank. I bet the behavior of waving its forelegs in front of it is helpful for the ID, but I don't know it. ID help appreciated and thanks.

So, the soil in the area where I photographed this is very sandy, and it is a mixed oak/hickory forest, if that helps. Thanks for the family placement.
