Size: ~ 3 mm
There was about a dozen of them hovering in a Black Hawthorn - Crataegus douglasii and yes the size is right.

Chloropid fly,
(so-called 'Frit, or Grass flies')and very nice images of these little things. (just curious, did you use a 60mm or 65mm macro lens for this, with flash?)
