In photo 2 you can use this as a reference in identifying the Grass-Skippers.
When they open their wings, the hindwings are held flat, while the forewings are held at a 45 degree angle, just like your photos shows.

The photos are both of Grass-Skippers. They're very common throughout the U.S and they're kind of fun to watch because they like to mess around with each other in a playful manner.
