I assume this midge had just emerged from the gall it was resting next to. The gall doesn't seem to match any of the 16 known creosote bush galls illustrated in (1), but 15 of the 16 are Asphondylia species, and the one Contarinia gall is nothing like this.

I think the gall might be a distorted flower, since it's at the end of a stalk, making this A. florea. I'm not certain though.
