Size: 4mm
A non-metallic long-legged fly, I believe. I found it flying around the leaves of a peony, but I brought it inside to photograph.

Moved from Sympycninae. I only see 1 pair of setae on the scutellum, no hairs, so Calyxochaetus, not Sympycnus.

 
Nodatus?
According to Robinson (1964)(1) only C. nodatus has a yellow first segment of the antenna (vs. brown or black in other species).

Identification
This female specimen belongs to the subfamily Sympycninae and most probably to the genus Sympycnus (or Calyxochaetus) with 28 and 21 species resp. in North America north of Mexico (see Pollet et al., 2004).
