Looks like Xanthorhoe labradorensis or X. packardata. Wish the pic was sharper.

The lack of a large tooth on the PM line, combined with the coloring at the base of the wings (among other features) should help to rule out Xanthorhoe packardata. Otherwise, JoAnne is correct.

If you read the remarks for each species you'll see both have the same coloring at the base of the wings. And dissection is the only way to determine, so I disagree with your assessment.
