Brachycaudus cardui
Pretty sure it is Brachycaudus cardui, that's the only species of Brachycaudus recorded on that Carduus nutans, but I've never seen it in real life. The other two species recorded on the genus don't fit. Brachycaudus helichrysi don't have the black patch and Brachycaudus lateralis is not recorded in North America.
