Looks like U. cardui; note also that the fly is sitting on a thistle (host plant of U. cardui).

thanks matthias...went on a search thru the web and found a picture of the same fly...the one i found was labeled as a male with a spike and the end of its body...is it possible this would be a female

 
It is the other way around...
It is the other way around... Yours is a male, and the females have an ovipositor for laying eggs (that is the spike like structure)...

It's late. I'm tired.
Search on spider mimic - no kidding - and I think you'll find this fly. (Markings on wings simulate a spider's front legs.)
