Picture-Winged Fly - Delphinia picta

Picture-Winged Fly - Delphinia picta
Mobile (Dog River), Mobile County, Alabama, USA
March 29, 2009
Not the best of photographs of this late afternoon, on-the-lam insect. However, I'm thinking the wing pattern is sufficient evidence to convict this insect of being a Delphinia picta, making it a first for Alabama. What is the jury's decision?

There is a precedent.

In this juror's opinion, the distinctive wing pattern and "gas mask" impart guilt by association. How say you?

Condemned to do community service on Bug Guide. Thank you for your time. You are now excused.

Thanks so much, Robert!
I've been trying (sorry) to find some kind of an excuse.
