There are a couple of things
There are a couple of things it could be however the scale of the images make it a bit tough to tell. My first thought was Aphaenogaster cockerelli, how when I saw the second I thought Pogonomyrmex rugosus. So now I am thinking along the lines of a Pheidole species. The apparent difference in head shape and size in the two specimens is pushing me towards Pheidole. A better side view would help alot.
