Mumetopia occipitalis (Anthomyzidae)
This aspect is a little distracting but I am quite certain this is Mumetopia occipitalis. The combination of only a single orbital seta, a densely ciliate arista (it appears to be here), and the general colouration leaves no other option in the Nearctic fauna. It is a female as eggs are visible through the abdominal membrane. Spring comes early in Gates!
