Confusing
According to Manual of Nearctic Diptera this should be Platyura or Orfelia, which are separated thus:

R2+3 ending in R1; base of M weak but distinct. Empodia present, large... Platyura

R2+3 ending in C; base of M absent. Empodia absent... Orfelia

I see R2+3 ending in C and base of M weak but distinct (visible only in one picture). More pictures of the wing or feet might help.
