Size: aprox 5mm
Found on some thistle, and milkweed near a stream. Doesn't like to fly, and doesn't seem to fly well.

The eyes and the host plant seem to make it a possibility, at least. Suggest moving the post to Diptera for expert attention.

Urophora cardui
Would I be able to put it directly into the species Urophora cardui given that the wing patterns seem pretty distinctive amongst the species?

They're your pics, so it's ultimately your call.
However, if you want my advice, I wouldn't move them any deeper than family (Tephritidae) until a legitimate fly expert has had a look at them. There are just too many similar species. I recommend playing it safe.
EDIT: Or John could make the whole question moot. :)
