At first I thought it was a Phyciodes tharos but the white dots are throwing me.

because of the nature
of the marginal spots on the hind wing, I was leaning toward C. nycteis anyway, but it the location cinches it.

It is a female Checkerspot,
genus Chlosyne. It is probably C. nycteis, but it would help 1) to see the underside, 2) to know where and when you took the photo (New Mexico is a big state). C. gorgone looks similar, and occurs on the Plains in the northern part of the state. C. nycteis is in the mountains.

 
Sorry
I usually put the location. Not sure how I forgot it this time. It was in Ruidoso. I stood there for 5 minutes and it kept it's wings like this the whole time. I was hoping it was a checkspot but didn't think the markings matched.

Also I took it yesterday around 4:30pm. Again I am sorry I forgot all this info before.

 
C. nycteis
Not an expert. But if I understand correctly, Ruidoso is a mountainous resort area in SE New Mexico. So, if as stated above, C. gorgone is more associated with plains, your butterfly probably isn't that one. If there are only two choices ... I'd vote for C. nycteis. From field guides, I gather neither of these species is expected in SE NM; but Kaufman shows C. nycteis south to the border. What a confusing (though totally gorgeous) butterfly!
