This appears to be a March Fly, perhaps a Bibio sp
The Capsula seems to be much lighter and not smooth as others I have seen.

What about the size. Aren't fungus gnats suppose to be less than 3mm?

Indeed, it is a female specimen of Mycetophila sp. (Mycetophilidae). In the second image you can see the distinctive bristles at the upper edges of anepisternum and anepimeron. The majority of "Fungus Gnats" (Sciaroidea) are tiny. But within the family of Mycetophilidae you will find also some "bigger" ones like this one. Size is not a good character to seperate or identify taxa, because there is usually intraspecific variability.
