im not sure but i think its a Japanese hornet we have them at our house they are scarey & painful

 
Not the Japanese Hornet...
One of the Yellowjackets, but I can't tell you the species. They are pretty temperamental around their nests, but alone are pretty unlikely to harm you. This appears to be a male, which do not sting. Treat them carefully regardless.
