Size: 5-7mm
I think it's a fly, because of the two wings thing, but it looks like a bee. Very small. (Flower is Helichrysum (Bracteantha) Yellow "Strawflower")

Neat little guys and often very colorful. Lots of kinds. Check these:



Strangely enough, bee flies look less like bees when at rest, though they do look like them in flight. Search "bee flies" for more on that topic.

 
this one looks like
a female (pointed abdomen) Toxomerus geminatus - the scutellum is blackish with a well-defined yellow margin, and the margin of the abdomen is alternately black and yellow, whereas in T. marginatus the scutellum is brownish and/or yellowish, and the abdomen has a continuous thin yellow margin
