Unknown Fly - Themira - Male

A lek of these has been displaying in a patch of dirt in some overwintered kale plants for the last few days. Much waving of wings, flitting about and skirmishes, all of which attracted my attention in the first place.

Linking images as I doubt these are the same specimen.
