All of the above!
In Europe, Syrphidae are known as "hover flies." Syrphid specialists in America swear they should go by "flower flies." This specimen is of an Eristalis sp., probably E. tenax, the "drone fly." Confused yet?:-)

Maybe
You may well be right. Posture etc. are correct but the characteristic vertical hair bands on the eyes are not visible in this picture.
